Is Yellow 5 Bad for You?
The FDA’s stated concern is sensitivity. It says allergic-type reactions to color additives are possible but rare, and that FD&C Yellow No. 5 may cause itching and hives in some people. Federal rules require foods containing Yellow No. 5, including butter, cheese and ice cream, to specifically declare it among the ingredients, and the FDA says that on medicine labels it must also be identified by its uncertified name, tartrazine.
Federal policy is moving away from synthetic dyes. In April 2025 the FDA said it was working with industry to eliminate six remaining synthetic dyes, including FD&C Yellow No. 5, from the food supply by the end of next year.
West Virginia’s food adulteration law names FD&C Yellow No. 5 among added substances it calls poisonous or injurious to health, with the 2025 amendments effective January 1, 2028. On December 23, 2025 a federal court granted a preliminary injunction barring the state health department from enforcing that law, H.B. 2354, and the appeal was tentatively calendared for argument in the Fourth Circuit during its December 8 to 11, 2026 session.
